Yes, this is that dreaded fine print!  It is written in plain English and not intended to be boring or irrelevant.  The fact that you do not take the time to read it, does not release you from your obligations under these terms and conditions.  By bidding, you are declaring that you have read, understood and agreed to these terms and conditions.  If you have any questions or concerns, please raise them with us prior to bidding.  Thank you.

Purchases
All purchases completed through eBay or OZtion are final.  The cooling off period is 7 days from the date of sale during which time the 7 Day Money-Back Guarantee will apply (see below for applicable conditions).  Goods will not be dispatched until full payment including shipping costs have been received in full.

Stock Runout
In the event of stock being exhausted, Finache reserves the right to supply ordered product/s to the earliest paying customer/s (verified by the date and time of successful transactions).  All subsequent payments will be refunded in full (including shipping charges) or placed on backorder with the purchaser's consent where future stock can be obtained. Although Finache will use its best endeavour to re-source runout items, we give no guarantee of future availability of any item and our liability is limited to a refund of the purchase price of that item and any associated shipping costs.

External Providers
All transactions through eBay, OZtion and PayPal are conducted subject to their respective terms and conditions.  Finache accepts no liability for non-completion of any transaction due to eBay, OZtion or PayPal faults or policy changes and is under no obligation to dispatch goods in such instance.

Communication
All communication will be conducted in the following order of preference:
        - via regular email to the address provided by the purchaser
        - via eBay or OZtion's messaging systems to the purchaser's member name
        - via telephone where it has been provided by the purchaser
At our sole discretion we may elect to correspond via postal mail to the postal address provided by the purchaser in the event that none of the above are available, are not responded to within 7 days, or for correspondence of a legal nature, however you agree that we are under no obligation to do so.

Shipping
Unless otherwise agreed beforehand in writing by email, all items will be shipped via third party courier or Australia Postal services at our discretion.  If you have a preference, please request it prior to dispatch and we will be happy to send it via your preferred method once the appropriate charges have been paid.  Shipping prices quoted in our eBay and OZtion auctions are subject to verification before the sale will be deemed to have been concluded.  Shipping prices quoted are to major capital cities within Australia only and may include a nominal handling fee.  In the event that shipping to a customer's location is higher than that quoted, the extra charges will be passed on in full to the customer and the item/s will not be dispatched until full payment has been received. 

Delivery
Consignments sent via courier cannot be delivered to Post Office Boxes.  Please provide a street address for courier delivery.  We will not dispatch your item/s until we receive your street address.  Ordinarily our courier will not leave an item without a signature unless it has been authorised beforehand by us.  If you wish for your consignment to be left without a signature, please request this prior to dispatch.  In doing so, you release Finache from any liability for delivery to the wrong address.

Non-Delivery
Unfortunately, despite our best efforts, sometimes items are not delivered as and when intended for a host of reasons.

  • Nobody Home - Where our courier is unable to obtain a signature and in the absence of authorisation to leave the item without a signature, the item will be returned to the courier's local depot.  You are invited to contact the depot via the phone number on the calling card to arrange redelivery.

  • Courier Redelivery - If the item is redelivered (whether you request it or the courier makes a second attempt) and where the courier charges us for redelivery, we will invoice you for the cost of redelivery as it is passed on to us (it will never exceed the original shipping charge).  By bidding on this item, you agree to pay any such redelivery fees and in the event of non-payment of any such redelivery fee, you agree that we may take legal recovery action under the Trade Practices Act.

  • Returns - After two unsuccessful attempts to deliver a consignment, the courier may return the item to us whereupon we will contact you for further instructions.  The consignment will only be re-dispatched upon receipt of the appropriate second shipping charge.  In the event that the re-delivery charge remains unpaid for more than 30 days, and where you have not organised for collection of your item/s, they will be considered abandoned and may be offered for resale.  In this event, you release Finache from any liability whatsoever in respect of your purchase.

Shipping Insurance
Insurance for items in transit is not included unless specifically agreed and quoted in writing with us before bidding.  Finache warrants that all items are dispatched in brand new condition and cannot accept liability for goods damaged in transit.  Finache is not liable to replace or refund any items damaged in transit.

Abandoned Goods
If for any reason we are unable to dispatch items for which payment has been received for more than 30 days, the items will be deemed abandoned and we reserve the right to offer them for resale.  In this event, you agree that Finache is released from any liability whatsoever in respect of your purchase.  Reasons whereby items will be deemed abandoned may include...
       - Where a street address has not been provided for courier delivery despite our email request.
       - Where legitimate additional shipping charges have not been paid by the purchaser despite our email request.
       - Where legitimate redelivery charges have not been paid by the purchaser despite our email request.
       - Where items that have been returned under the 7 day money-back guarantee are found to have been opened or
          used and a legitimate redelivery charges have not been received despite our email request.
       - Where an item returned to us under warranty claim is found to have been damaged by human causes and legitimate
         redelivery charges have not been received despite out email request.
In the event that no payment has been received from a winning bidder for more than 7 days we will lodge an unpaid item notification with eBay or OZtion, which if unresolved for more than 7 days will result in the sale being voided altogether.

7 Day Money-Back Guarantee
If for any reason you are not completely satisfied with any item purchased from us through eBay or Oztion, you may return it within 7 days for a full refund (excluding shipping charges).  To qualify for this money-back guarantee, the item must be unopened and the original seals intact.  The cost of returning the item is to be borne by the purchaser.  By opening any purchased item, you thereby void this money-back guarantee.  Any items returned to Finache which are found to have been opened will be returned to the original purchaser only once reasonable shipping charges have been paid.  In the event that such shipping charges remain unpaid for more than 30 days, the original purchaser will forfeit their rights to the item meaning it can be disposed of at our discretion without any liability to compensate or reimburse the purchaser.

Refunds
Except as provided for under our 7 Day Money-Back Guarantee, no refunds are available.

Warranty
Except as otherwise stated, all items purchased are covered by a 30 day warranty during which time if the product is found to be defective it will be replaced or where the identical item is no longer available, refunded in full (shipping costs excluded).  Items are not tested prior to dispatch.  To be eligible for a warranty replacement or refund, the purchaser must return the faulty item/s to Finache at their own cost.  Items found to be damaged due to human causes  (including accidental damage) other than normal expected wear and tear will be excluded from this warranty.

Feedback
We aim for 100% positive feedback, both given and received. This is your best guarantee of top service from us as we have no control over the feedback our customers leave about us. Before you bid, it is worth taking a few minutes to read what past customers say about their experience with us. Where a winning bidder fails to pay within 7 days and fails to communicate with us within 7 days despite our efforts to establish contact, in the interests of maintaining the highest standards of professionalism within the eBay community, we are obliged to leave an honest account of the experience.  Otherwise we will not leave feedback for buyers until it has been left for us.  Please take the time to leave feedback after you have received your item/s as it helps all eBay and OZtion users know which sellers can be trusted.

GST
Goods & Services Tax (GST) of 10% is included in your winning bid as required under Australian taxation law.  Overseas purchasers are not exempt from paying GST, but may apply directly to the Australian Taxation Office for it to be reimbursed where eligible.  Finache makes no warranty that any application for reimbursement of GST will be successful and accepts no liability therefore.  All purchasers will be issued with a Tax Invoice as required by Australian law.

Changes to Terms & Conditions
Finache reserves the right to vary these Terms & Conditions at any time without notice.  All sales are deemed subject to the Terms and Conditions in place at the time of the sale.

Applicable Laws
All dealings with Finache will be subject to and interpreted under governing laws in the state of Victoria in Australia without reservation and by bidding, you agree to this.
